Fair Use Guidelines

What is fair use? Though not numerically defined, fair use has legally been grounds for reproducing small amounts of copyrighted work without the need to request the rights holder's permission. The small amount of text must always be attributed to the source; use is never fair if the source is not noted.
Does Eerdmans Publishing Company have a fair use policy for quotations? Yes. Please note that though we include quantitative guidelines, context is more significant than word count. Please read the following guidelines carefully. They are similar to those of other academic publishing houses and are as follows:

  1. Types of use considered fair: quotations of Eerdmans material within your text (print, electronic media, sermon, etc.) for the purposes of criticism, commentary, definition, comparison, or illustration of your argument.

  2. Guidelines: Use must comply with all of the following guidelines.
    1. No more than 5,000 words, in total, from one Eerdmans volume may be reproduced without permission.
    2. No more than 5% of the source work may be reproduced and no complete poems, children's books, or songs may be reproduced without permission.
    3. No more than 300 consecutive words may be reproduced without permission.
    4. Eerdmans material may not make up more than 5% of the new work.
    5. Ellipses (…) may not be used in ways that alter the ideas of the original work.
    6. Eerdmans material must be properly cited in a manner that conforms to a scholarly style.

  3. Works not covered by fair use:
    1. Reproduction of Eerdmans material in an anthology, devotional volume, course reader, website, electronic database, or musical work or adaptation is not permitted without permission.
    2. Reproduction of Eerdmans material in a "text box," or epigraph, where the text stands alone rather than being incorporated into the discussion by the author is not permitted without requesting permission.
    3. Reproduction in which there is no suitable bibliographic citation is not permitted.
    4. Reproduction of charts, maps, illustrations, photographs, or cover images is not permitted without requesting permission.

Must churches ask permission in situations where use is not considered fair? In addition to the material considered fair (above), churches may reproduce stand-alone quotations in bulletins or on documents to be shown on a screen (such as PowerPoint or overhead projectors) without asking permission provided that the source is fully documented. All other uses require that permission be requested.

Photocopy Requests

How do I request permission to photocopy? To request permission to photocopy Eerdmans material you must fax your request to the attention of the photocopy permissions department (616.742.6115). Please include the following information:
  • your name
  • organization affiliation (if applicable)
  • email address
  • phone number
  • fax number
  • address
  • title of the Eerdmans publication
  • author or editor of the Eerdmans publication
  • ISBN
  • publication or copyright date
  • Is the book currently available for sale on www.eerdmans.com?
  • Is this a photocopy request or a request to post material on a password secured electronic database?
  • page numbers you wish to use
  • exact page count
  • number of copies to be made
  • intended use for the copies

NOTE: Information listed in red MUST be included in order for your request to be processed.

My institution wants to post Eerdmans material on a password-secured website. How do we request permission? You may ask permission by submitting the same information as above.
Does Eerdmans allow churches to photocopy material for use in Bible studies or classes? Yes, churches in the United States of America may make photocopies of Eerdmans material without asking permission provided the following stipulations are followed.
  1. Churches and small groups in the United States of America may photocopy up to five pages of a book for study use without asking permission for up to twenty copies. If more copies are to be made, permission must be requested in the manner described above.
  2. Groups taking advantage of this policy must include a source citation on each photocopy; if the book is in print and available for purchase, this citation must include Eerdmans' website, www.eerdmans.com.
  3. Religious educational institutions and not-for-profit organizations affiliated with churches must ask permission to make photocopies.
  4. Churches outside the United States of America must request permission as described above.
My favorite book went out of print. Will it ever be available for purchase again? If you need more than 15 copies of a book that is out of print, it may be possible to add it to the books on demand program. To inquire regarding this possibility, please email bod@eerdmans.com.
 
Excerpt and Anthology Permissions

How do I request permission to use Eerdmans material in my work? First, determine if your use constitutes fair use (above). If in doubt, ask permission. If your use requires permission, submit your request by fax (616.742.6111) or email rights@eerdmans.com. You are required to include the following information:
  • your name
  • organization affiliation (if applicable)
  • email address
  • phone number
  • fax number
  • address
  • title of the Eerdmans publication
  • author or editor of the Eerdmans publication
  • ISBN
  • publication or copyright date
  • your publisher
  • quantity to be printed
  • page count of your work
  • expected retail price of your work
  • expected publication date
  • countries of distribution
  • page numbers you wish to use
  • exact page/word count
  • book type (check all that apply): _hardcover _softcover _textbook _curriculum _gift book _periodical
  • brief explanation of text use

NOTE: Information listed in red MUST be included in order for your request to be processed.

May I request permission if I don't have a publisher? No. It is Eerdmans' policy not to grant permission until you have contracted with a publisher. Once your work is accepted for publication then you may ask permission to use our material.
How long will I wait for a response? Because of the number of permissions requests we receive, we sometimes need up to six weeks to respond to an inquiry, though some simple requests may be answered the week they are submitted. Additionally, a few requests are difficult to respond to because they require that we check with a third party.
I can't wait for a response. I need an answer now. In some situations, we are able, for a $50.00 fee, to rush permissions requests. This fee is in addition to whatever permissions fee is required. Rushed permissions requests will be answered within one or two business days. Requests submitted on Friday will be answered on Monday or Tuesday. If, for some reason, we are unable to answer the request in this time, the rush fee will be waived. If you wish your request to be rushed, please note it in writing.

If you wish to translate and publish any Eerdmans titles (in or out of print), please submit the following information by fax (616.742.6111) or email rights@eerdmans.com:
